Welcome to GoFans. These Terms & Conditions ("Terms") govern your access to and use of the website www.gofans.in, the application at app.gofans.in, and all related services (collectively, the "Platform").

The Platform is owned and operated by STEHAWK PRIVATE LIMITED(CIN: U72900TG2020PTC140586), a company incorporated under the Companies Act, 2013, having its registered office at 2-2-1130/19/4, Flat No S2, Shivam Apartments, Prasanth Nagar, New Nallakunta, Hyderabad, Telangana — 500044, India ("Company", "we", "us", "our").

By registering on, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About the Platform

GoFans is an online creator monetization platform that enables content creators ("Creators") to offer paid memberships, exclusive content, tips, digital products, and related services to their supporters ("Fans"). The Company acts as an intermediary within the meaning of the Information Technology Act, 2000 and provides the technology platform that connects Creators and Fans. The Company does not create, own, or endorse content uploaded by Creators.

2. Eligibility

  • You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to use the Platform — whether as a Creator or as a Fan.
  • By using the Platform, you represent and warrant that you meet these requirements and that all registration information you provide is true, accurate, and complete.
  • We reserve the right to suspend or terminate accounts that misrepresent age or identity.

3. Accounts & Security

  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • You must notify us immediately at support@gofans.in of any unauthorized use of your account.
  • One person may not maintain multiple accounts for abusive or fraudulent purposes.

4. Creator Terms

4.1 Verification (KYC)

Creators must complete identity verification, including submission of PAN and other government-issued identity documents, before receiving payouts. We may use third-party verification services and government-authorized frameworks (such as DigiLocker) with your consent for this purpose.

4.2 Content Ownership & License

  • Creators retain full ownership and copyright of the content they upload.
  • By uploading content, the Creator grants the Company a limited, non-exclusive, royalty-free, worldwide license to host, store, reproduce, transmit, display, and distribute such content solely for the purpose of operating and promoting the Platform.
  • Creators represent and warrant that they own or have all necessary rights to the content they upload, and that such content does not infringe any third party's intellectual property, privacy, or other rights.

4.3 Earnings, Commission & Payouts

  • Creators may earn through memberships, tips, digital products, and other monetization features offered on the Platform.
  • The Company charges a platform commission on transactions, as published on the Platform or otherwise communicated to the Creator at the time of enabling a feature. Payment gateway charges and applicable taxes may also be deducted.
  • Payouts are made to the Creator's verified Indian bank account, subject to minimum payout thresholds and settlement timelines published on the Platform.
  • The Company may deduct tax at source (TDS) and comply with other tax obligations as required under applicable law. Creators are responsible for their own income tax and GST obligations on their earnings.

4.4 Content Standards

All content must comply with our Community Guidelines and Section 6 below. The Company reserves the right to review, moderate, restrict, or remove content that violates these Terms.

5. Fan Terms

  • Fans may purchase memberships, send tips, and buy digital products offered by Creators.
  • All prices are displayed in Indian Rupees (INR) unless otherwise stated.
  • Payments are processed through RBI-authorized third-party payment gateways. The Company does not store your card or banking credentials.
  • Memberships provide access to a Creator's exclusive content for the subscribed period. Access is personal, non-transferable, and may not be shared, re-sold, downloaded for redistribution, or leaked. Violation may result in account termination and legal action.
  • Refunds and cancellations are governed by our Refund & Cancellation Policy.

6. Prohibited Content & Conduct

The following are strictly prohibited on the Platform. This list is illustrative, not exhaustive:

  1. Nudity, pornographic, sexually explicit, or obscene content of any kind, including content that violates Sections 66E or 67/67A of the Information Technology Act, 2000 or Section 294 of the Bharatiya Nyaya Sanhita, 2023;
  2. Any content involving minors that is sexual, exploitative, or harmful; the Platform has zero tolerance and will report such material to authorities;
  3. Content that infringes copyright, trademark, or other intellectual property rights;
  4. Hate speech, harassment, threats, or content promoting violence or discrimination;
  5. Content promoting illegal activities, gambling, weapons, or narcotics;
  6. Misinformation intended to deceive, defraud, or cause public harm;
  7. Impersonation of any person or entity, or misrepresentation of affiliation;
  8. Uploading viruses, malware, or attempting to breach Platform security;
  9. Circumventing the Platform's payment systems to transact off-platform for content or services discovered on the Platform;
  10. Any activity that violates applicable Indian law, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

Violations may result in content removal, account suspension or termination, forfeiture of pending payouts where permitted by law, and reporting to law-enforcement authorities.

7. Content Moderation & Intermediary Compliance

  • The Company observes due diligence obligations under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
  • Content may be reviewed through automated tools and human moderation.
  • Any person may report content believed to violate these Terms or applicable law through the in-platform reporting feature or by writing to grievance@gofans.in.
  • Upon receiving a valid complaint or lawful order, we will act within the timelines prescribed under applicable law.

8. Intellectual Property of the Platform

The GoFans name, logo, Platform design, software, and all materials created by the Company are the property of STEHAWK PRIVATE LIMITED. Nothing in these Terms grants you any right to use our trademarks or brand assets without prior written permission.

9. Fees, Taxes & Invoicing

  • Platform commissions and fees are exclusive of applicable taxes (including GST), which will be charged additionally where required.
  • The Company will issue tax invoices for its commission/fees in accordance with GST law.

10. Disclaimers

  • The Platform is provided on an "as is" and "as available" basis. We do not warrant uninterrupted or error-free operation.
  • The Company is not a party to the relationship between a Creator and their Fans beyond providing the Platform, and does not guarantee any level of Creator earnings or content quality.

11. Limitation of Liability

To the maximum extent permitted by law, the Company's aggregate liability arising out of or relating to the Platform shall not exceed the total platform commission earned by the Company from the user concerned in the three (3) months preceding the claim. The Company shall not be liable for indirect, incidental, or consequential damages.

12. Indemnity

You agree to indemnify and hold harmless the Company, its directors, and employees from any claims, damages, or expenses (including legal fees) arising from your content, your breach of these Terms, or your violation of any law or third-party right.

13. Suspension & Termination

We may suspend or terminate your access to the Platform for breach of these Terms, suspected fraud, legal requirement, or risk to other users. You may delete your account at any time; provisions relating to content licenses (for content already distributed), payments due, indemnity, and limitation of liability survive termination.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Subject to any mandatory arbitration or consumer-law rights, courts at Hyderabad, Telangana shall have exclusive jurisdiction.

We will acknowledge complaints within 24 hours and endeavour to resolve them within 15 days, or such shorter period as prescribed by law.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified on the Platform or by email. Continued use after changes take effect constitutes acceptance.
